Terms and conditions of use

The company Camas Inteligentes S.L. (CIF: B95767919) and registered in the Mercantile Registry of Bizkaia, volume 5481, folio 71, and sheet nº BI64853 entry 1, is the owner of this website, operating under the trade name Vilma-Sleep.

These general conditions are formulated in accordance with the Civil and Commercial Codes, Law 7/1996, of January 15, on Retail Trade Regulation, Law 7/1998, of April 13, on General Conditions of Contracting, and Law 7/1995, of March 23, on Consumer Credit.
Placing an order implies acceptance of these General Sales Conditions by the customer, as well as any others specified in the order itself.

Furthermore, the customer of Vilma-Sleep affirms to be of legal age and verifies that all the data provided for the management of their order is correct.



1.OBJECTIVE

These General Sales Conditions aim to define the sales methods between Camas Inteligentes SL and the customer, from order placement, delivery and payment, as well as after-sales service.



2. ORDER

The CUSTOMER can place their order through the following means:

  • Via email indicated on our website, info@dormideo.com.


To place an order, the Customer must provide us with their personal data, which will be stored in the Camas Inteligentes SL database. If they place another order, their data will not be requested again as we will already have their password.

The Customer's order placement equates to full and complete acceptance of the prices, the description of the products for sale, and the General Sales Conditions, as well as any others specified in the order itself.



3.DELIVERY.

Shipping costs are free for mainland shipments on orders over 60€.

Vilma-Sleep does not ship orders to Ceuta, Melilla, and the Canary Islands.



In case the transport agency, in this case, MRW, does not find you at home, the agency will leave a notification with a phone number to arrange a new delivery within a maximum period of 10 days.
At Vilma-Sleep, we track each order, so if any incident occurs with your shipment, we will inform you as soon as possible.
If a delivery date is agreed upon with you by the transport agency, and the delivery cannot be made because you are not at home, additional charges may be applied for a second delivery attempt.

THE CARRIER IS NOT OBLIGATED TO CARRY THE MATERIAL TO THE HOME



4.PAYMENT

Vilma-Sleep offers 4 different payment methods. Once you have placed the order, the system will indicate which payment method you can use. Then, you just need to follow the instructions provided by the system.

Bank Transfer:

You can also choose to pay by bank transfer. Our bank is La Caixa.


Credit Card:

You can make your payment by credit card, selecting this option on the payment mode screen. This option will connect to a secure server.


PayPal: 

You can also choose PayPal as a payment method. 


Financed: 


You can finance your purchase through our partner company Pepper. 


5. PRICES

All prices and fees derived from the services provided from our Vilma-Sleep website, DO include value-added taxes.



6.CHANGES AND RETURNS

All Vilma-Sleep products are guaranteed against any manufacturing defects. To find out the warranty period, you should refer to each product's file where we inform you of the validity period of the warranty against manufacturing defects.

In case of manufacturing defects, Vilma-Sleep will replace the product with another one, provided the claim is documented to atencionalcliente@dormideo.com or any other legally valid means, attaching photos or videos of the cited defects. In this case, you will not incur any expenses.

Promotions or discounts that the initial order may have had will not apply to product changes, nor any other promotion that is in effect at the time of the change.

If there are no manufacturing defects, and you want to exercise our 30-night trial warranty by opting for a mattress replacement, Vilma-Sleep informs you that:

  • If the price of the newly chosen product is lower, Vilma-Sleep will refund the difference.

  • If the price of the newly chosen product is higher, you must pay the difference for the change to be made.

  • You can change the mattress for one of the same nature and size.

  • The transport cost of the change or return within the first 14 days from its receipt is at your expense, being 50€ (per product) for any mattress change or return in mainland Spain and 70€ (per product) for the Balearic Islands, Andorra, and Portugal, provided the products are in their original packaging and have not been used.

  • Exceptional satisfaction guarantee: The cost of the change, in this case, within the first 30 days from its receipt,  if the mattress has been unpacked and/or used will be 100€ (per product) for changes in mainland Spain and 120€ (per product) in the Balearic Islands, Andorra, and Portugal.

The 30-night trial warranty of Vilma-Sleep only applies to mattresses. All other items on the website are excluded.

Remember that if you use the 30-night trial warranty, the replacement mattress we send you will not be eligible for withdrawal, even if it is perfectly packaged.

If the change is accepted by Vilma-Sleep, we will give you written instructions via email on how to prepare the mattress for the carrier to collect it. The product collection will be carried out by the transport company, and it is the customer's responsibility to ensure it can be done without issues and on the ground floor of the building. To accept a product change or return, Vilma-Sleep will ask for photos or graphic supports to observe the product's condition. Only products in perfect condition will be accepted for changes or returns.

6.1 Right of Withdrawal

According to the applicable regulations, if you are contracting as a consumer, you may withdraw from the contract except in cases where the law explicitly excludes the possibility of withdrawal due to the product's specialty or for certain reasons, including hygiene. Vilma-Sleep lists in section 6.2 those products excluded from the right of withdrawal.

In other cases, you may withdraw from your order within 14 days from the delivery date. The product must be in its original packaging and not used.

In this case, Vilma-Sleep will refund the full price paid for the products within 14 days of accepting the return. The consumer will bear the return shipping costs according to current regulations.

We inform you that the return shipping costs are as follows:

  • Mattresses in their original packaging 50€ (per unit)
  • Upholstered base Offer in its original packaging 50€ (per unit)
  • Bases in their original packaging 50€ (per unit)
  • Bedding in its original packaging 12€ (per unit)
  • Toppers and crib mattresses in their original packaging 25€ (per unit)

The right of withdrawal can be exercised by any means permitted by law. We especially provide our email info@dormideo.com for you to communicate your desire to exercise your right of withdrawal. To complete your right of withdrawal, you must send us photos or videos of the merchandise so that we can check its condition and process the withdrawal. The photos or videos must be sent before the 14 days from the receipt of your order expire, so that Vilma-Sleep can process your right of withdrawal within the legal timeframe.

In addition to the legal right of withdrawal, Vilma-Sleep provides you with a 30-night trial warranty which allows you to make changes to the mattresses within 30 days from the receipt of the same.

6.2 Exceptions to the Right of Withdrawal

Vilma-Sleep informs you that you will not have the right to withdraw from the contract or change the product when the subject of the same is:

  • Bedding that is not in its original packaging and unopened.
  • Pillows.

7.WARRANTIES

All Vilma-Sleep products are guaranteed against any manufacturing defect with a minimum of three years as required by law. In the case of a defective product, the seller must respond to the lack of conformity that appears within three years from delivery.

The consumer and user must inform Vilma-Sleep of the lack of conformity within two months of becoming aware of it. In the case of a defective product, the seller must proceed, as appropriate, to the repair, replacement, price reduction, or termination of the contract, which will be free for the consumer and user.

To find out which products have a longer warranty period, you should refer to each product's file where you can find the validity period of the warranty.



8.PROTECTION OF PERSONAL DATA

In accordance with Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that your personal data, which may be contained in this communication, are incorporated into an automated file under the responsibility of Camas Inteligentes, S.L., CIF: B95767919. The purpose of this file is to manage the business relationship and inform you of our services. These data will not be transmitted to third parties.

Additionally, to access some services that Camas Inteligentes, S.L. offers through this website, you must provide some personal data. In compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that, by filling out the form, your personal data will be incorporated and processed in the files of Camas Inteligentes, S.L. to provide and offer our services, as well as to inform you of website improvements.

If you wish to exercise your rights of access, rectification, cancellation, or opposition, you can write to: Ctra. nacional 340 km 1052 – 12500 Vinaroz (Castellón), or send an email to info@dormideo.com.

The user accepts that all their personal data will be fully transferred to Pepper from the moment the user has begun contracting the deferred payment service offered by the latter when choosing the payment method. This acceptance extends to third parties that must access the files for the good end of the contract.

 

9.INDUSTRIAL AND INTELLECTUAL PROPERTY

This website is owned by Camas Inteligentes, S.L.. The Intellectual Property rights and rights of exploitation and reproduction of this website, its pages, screens, the information they contain, its appearance and design, as well as the hyperlinks established from it to other web pages of any subsidiary and/or dominated company of Camas Inteligentes, S.L., are the exclusive property of this company, unless expressly specified otherwise.

Any name, design, and/or logo, as well as any product or service offered and reflected on this website, are duly registered trademarks of Camas Inteligentes, S.L., its subsidiaries, and/or dominated companies, or third parties.

Any misuse of these by individuals other than their legitimate owner and without the express and unequivocal consent of the latter may be reported and prosecuted through all legal means available in the Spanish and/or Community Legal System.

The intellectual property rights and trademarks of third parties are properly highlighted and must be respected by anyone accessing this page. Camas Inteligentes, S.L. is not responsible for the use that THE USER may make in this regard, with the sole responsibility falling on the user.

Downloading, copying, or printing any page of this website is allowed only for personal and private use. It is forbidden to reproduce, transmit, modify, or delete the information, content, or warnings on this website without the prior written authorization of Camas Inteligentes, S.L.

Camas Inteligentes, S.L. does not transfer ownership of its software to users. The user owns the medium on which the software is recorded. Camas Inteligentes, S.L. retains all industrial and intellectual property rights, including the software. 10. APPLICABLE LAW AND JURISDICTION

These general conditions are governed by Spanish Law, with the Spanish Courts and Tribunals being competent to hear any questions arising about the interpretation, application, and compliance with them. THE USER, by virtue of accepting the general conditions contained in this legal notice, expressly waives any jurisdiction that, by application of the Civil Procedure Law in force, may correspond to them.

 

11. COOKIES NOTICE

We inform you that for the proper functioning of the www.dormideo.com website, owned and managed by Camas Inteligentes, S.L., the navigation system uses some browsing data (“Cookies”) to provide a more personalized service to web users. “Cookies” are small text files that the browser saves when browsing web pages and applications. Information such as the IP address used by the computer to connect to the website, the URL of the requested web page, the connection time, and other parameters related to the operating system of the user's computer environment can be obtained.
